Your nerd word of the week is … Hearsay. A hearsay statement is one that a trial witness may have heard someone else — who is not a witness — say outside of court. In other words, it is not a statement by a trial witness with firsthand knowledge. In general, most judges will not allow hearsay statements to be used as trial evidence, but there are lots of exceptions to the rule, particularly in federal court.
